A WOMAN injured while having sex in a motel room paid for by her employer deserved the same treatment as someone who had slipped in the shower or been bashed, her lawyer has argued.

Barrister Leo Grey told the Federal Court this morning that his case involing s a public servant’s fight for compensation after being injured during a night of passion,  "wasn’t about sex."

The federal government employee, who cannot be identified, was injured when a glass light fitting came away from the wall above the bed as she was having sex with a man on November 26, 2007.

The light struck her in the face, leaving her with injuries to her nose, mouth and a tooth, as well as "a consequent psychiatric injury", described as an adjustment disorder.

She claims entitlement to compensation because her injuries were caused "during the course of her employment", as she had been sent to a country town to stay the night ahead of a meeting early the next day.

"this is no different than slipping over in the shower or being bashed by a gang of thugs after a dispute over a woman," Mr Grey said.Mr Grey said that it had been her employer who placed her in the motel for work purposes and that the AAT had erred in its finding that she was not entitled to compensation.Mr Grey said "the lawful sexual activity" was considered reasonable behaviour for a motel room as "it’s not the 1920s."but Andrew Berger, counsel for Comcare, submitted that having sex was not a "necessary activity" for a motel room, in the same way that "showering, bathing or sleeping" is.The government’s workplace safety body ComCare rejected her compensation claim, upheld by the Administrative Appeals Tribunal, finding the sexual activity "was not an ordinary incident of an overnight stay like showering, sleeping or eating".

In submissions filed to the court, the woman’s lawyers have argued that being injured while having sex "during an interval or interlude within an overall period or episode of work" was no different to being hurt doing other recreational activities.

"Serious drinking and socialising may be regarded as a recreational activity, yet injuries resulting from those activities … have been found to be compensable," her lawyers argue.

Rebels in Libya’s Western Mountains launched an offensive today against Muammar Gadafy’s troops, one day after Britain granted diplomatic recognition to the opposition.

With prospects of a negotiated settlement fading, both sides appear to be preparing for the five-month-old war to grind on into the Muslim holy month of Ramadan in August.

“We have started attacking Ghezaia with rockets and tanks,” rebel spokesman Mohammed Maylud said.

Ghezaia is a town near the Tunisian border which has been in government hands since the conflict began.

At a checkpoint outside the nearby rebel-held town of Nalut, they sounded optimistic as the fighting began.

“We are confident we can beat Gadafy now, we have captured more weapons from the Libyan army, mostly AK-47s,” said Mohammed Ahmed (20) a market trader turned fighter.

Basim Ahmed, a fighter coming back from the front, said rebels had taken control of parts of three villages and many government troops had fled, but this was not possible to verify.

As sustained bombardments could be heard in the distance, an ambulance raced to Nalut hospital. a rebel with a gunshot wound to the shoulder was brought into the emergency room, where he lay semi-conscious.

Minutes later a commotion could be heard in the parking lot. a government soldier who had been captured was led to a hospital bed a few feet away from the rebel. he was missing a hand and was barefoot.

The soldier, who gave his name as Hassan, said that the army was losing the will to fight.

“We don’t want to keep fighting. everybody is against us.” he said, speaking from his hospital cot.

Blood seeped through the bandage bound around the stump of his missing hand but a rebel nonetheless tried to interrogate him, asking him his unit and where he was from.

Eight wounded combatants lay in the hospital in total — four rebels and four Col Gadafy soldiers. Six other Col Gadafy soldiers had been taken prisoner, witnesses said.

Rebels have taken large swathes of Libya since rising up to end Col Gadafy’s 41-year rule.

They hold much of the Western Mountains range, northeast Libya including their stronghold Benghazi, and the western city of Misrata.

Yet they remain poorly armed and are often disorganised. despite the backing of Nato air strikes, they have failed to reach the capital Tripoli and appear unlikely to do so soon.

Ghezaia is of local strategic importance, a base from which government troops attack rebels in the mountains, but if it fell this would not bring the opposition nearer to Tripoli.

Col Gadafy has scoffed at the rebels’ efforts to end his rule and has weathered a rebel advance and Nato air raids on his forces and military infrastructure.

A recent flurry of diplomatic activity has yielded little, with the rebels insisting Col Gadafy step down as a first step and his government saying his role is non-negotiable.

United Nations envoy Abdel Elah al-Khatib visited both sides this week with plans for a ceasefire and a power-sharing government that excludes Col Gadafy, but won no visible result.

Asked about Mr Khatib’s proposal, rebel leader Mustafa Abdel Jalil said: “We were surprised the day before yesterday that we are taking 10 steps back… and he says to share power with Muammar Gadafy’s regime. this is laughable.”

Col Gadafy also appeared defiant yesterday, urging rebels to lay down their arms or suffer an ugly death.

“We all lead this battle, until victory, until martyrdom,” he said in a message aired at a pro-Gadafy rally in Zaltan, 140km west of the capital Tripoli.

DADAAB, Kenya (AP) — Nurse Serat Amin works in the world’s largest refugee camp treating the stream of starving children coming into Kenya from famine-struck Somalia, and although he has painful memories of the children who have died, watching the weak get stronger gives him the courage to carry on.

“You can see if a child is getting better just from the face of the parent,” he said. “Making a difference is what keeps me here.”

Amin works at a stabilization ward at the International Rescue Committee hospital in the Dadaab refugee camp, where dozens of tiny children with stick-thin limbs and oversize heads loll on plastic mattresses. Mothers use their fringed shawls to flap the humid aid around their babies’ faces while patient nurses poke intravenous needles into tiny hands. Amin, walking about the ward in his yellow T-shirt, knows them all.

“Most come in here very sick. Mihag was unconscious when he came,” said Amin, speaking of a tiny 7-month-old the same size as an infant. “But today he is picking up a bit.”

The child, which weighed as much as a newborn when he arrived, has put on 3.5 ounces (100 grams) in the past few days. The wailing babies are weighed in a wicker basket suspended from the ceiling.

The U.N. says parts of Somalia held by Islamist rebels are suffering from famine, and a total of 11.3 million people in the Horn of Africa need aid. Amin said the situation is the worst he’s seen it — they’ve had up to 42 babies in his ward for malnourished babies at a time, a sevenfold increase at the hospital since the beginning of the year. The hospital is just one of three treating Somalis refugees in Dadaab camp.

Most of the children are also suffering from pneumonia and other diseases after hunger weakened their immune systems. That’s particularly painful for Amin: his own cousin lost his eyesight after suffering from malnutrition and measles. It’s what led him into nutritional medicine in the first place.

Now the wards are full of hungry babies with medical complications. on Friday, there were eight more patients than beds, so women had to share overnight.

“I’ve asked UNICEF to come with some tents so we can set them up outside and start treating more people,” said Amin.

The children come in with two types of malnutrition: marasmus, or straightforward starvation where the child is so thin its skin stands up in folds when pinched, and kwashiorkor, where the child has had food but no protein or nutrients.

Habiba Dubow’s son Abdirahman is one year old and weighs nearly 10 pounds (4.5 kilograms). He should weigh 22 pounds (10 kilograms). He is so thin his tiny ribs are clear through his skin and they barely lift with his breathing. when his mother takes his shirt off, his limbs flop back onto the bed and his eyes roll back in his head until only the whites are showing. He is too weak to cry.

“We walked here for 20 days after we lost all our cattle,” she said. “He got sick on the way.”

The kwashiorkor children often have peeling skin or sores, swelling of the limbs or stomach and reddish hair, like Hamud Mohamed Abdi. The 2-year-old also weighs only half what he should for his age, but doctors say he is improving and might go home next week if he can get extra food every day. His parents are rail-thin themselves.

The weakest children can’t even hold onto their mothers’ breasts to get milk and are fed through tubes in their noses. The U.N. says it is the worst emergency in Somalia since the famine in the early 90s that triggered an international intervention that ended after two U.S. Blackhawk helicopters were shot down.

“This influx of severe cases we have not seen before,” Abdi said.

Most have recently arrived in Kenya from Somalia, a war-ravaged nation which has not had a stable central government for more than 20 years. The refugees arrive on foot, or packed into dented minivans, praying that gunmen won’t rob them or rape their daughters before they arrive at the overflowing camp, where nearly 400,000 people have sought refuge.

Among them was a couple who arrived at Amin’s ward with twins. One had taken sick on the journey and was barely clinging to life. He slipped away in just a few hours. Amin said it made him want to cry for all day. From time to time he sees the parents, and he always makes a point of going to speak with them.

“The situation goes with you when you go home,” he said. “I think that for every life we save in this hospital, there are so many more behind them we can’t reach.”

The U.N. has warned that routes out of Somalia are turning into ‘roads of death’ after parents were forced to leave dead children along the roadside. The ones who make it to Kenya but are too hungry, too sick or too weak to survive are buried in a small sandy graveyards near the hospital compound.

Most graves have no markers apart from thorny branches piled on top of the mounds. Plastic trash bags catch in the thorns, fluttering in the wind. The earth on many of them is fresh but the small sandy hills soon drift back into the ground. nearby children play football or fly small kites made from twigs and discarded plastic bags.

But most children survive with treatment, even those whose own parents have already let go.

“There was a child we treated last year — Aden — we had to treat him intensively for seven days. We didn’t know if he would make it. His father and grandmother said, why are you taking him? He is already almost dead. now he’s walking around and his dad is talking about school,” said Amin.

“Sometimes you are walking in the camp and someone calls you by your name and you don’t recognize them, but they come up and thank you for helping their child.”

DOG mess is to be sprayed pink by South Lakeland District Council’s Enforcement Team today to shame owners who fail to clean up after their pets.

the aim is to encourage responsible dog ownership and the council wants to encourage all owners to ‘Bag it and Bin it’.

Councillors and staff from SLDC will be at the Gill in Ulverston this morning armed with cans of biodegradable pink spray.

they plan to highlight the amount of dog mess left behind by people who walk their pets in the area.

Poop scoop bags and information on how to keep the area free from dog mess will also be handed outi.

“This is a very real problem to residents across South Lakeland and even across the country,” said SLDC’s portfolio holder for Environment and Sustainability, Coun Clare Feeney-Johnson.

“I am hoping that we can show the minority of dog owners who do not act responsibly and clean up after their dogs, the affect on the community around them.”

the project is being launched as part of National Poop Scoop Week.

the council will also target other hotspot areas in the district.

Coun Feeney-Johnson added that the public should be aware that once the dog mess has been sprayed pink, the mess will be cleaned up by the SLDC Streetcare Team.

SAN ANGELO, Texas —Melody Allen, a piano teacher for 30 years, loves music and gardening. She and her husband, Stacy, also are collectors — of teapots and vintage stoves, hand-crafted baskets and birdhouses, hats and artwork and much more.

This past August, the Allens opened Music Garden Mansion, a bed-and-breakfast inn on Elm Street, steps from the Concho River and just northwest of downtown San Angelo. it took them 18 months to refurbish the 19th century boardinghouse into the four-suite inn, named for Melody Allen’s passions and filled to the brim with their collections.

“This is just a collection of my whole life, Music Garden Mansion,” Melody Allen said. “For 60 years, we’ve been collecting stuff. we go to auctions. Friends and family have just contributed.”

Allen said her grandmother settled in Robert Lee around 1900.

“My grandparents were all country people. They didn’t really have much. They were farmers in the Great Depression,” she said. “Some of the furnishings and items are from them. most of it is just stuff we’ve collected through the years. I’m a great collector of baskets. Have always been. I just like the natural weave. then there’s all the music memorabilia. As a music teacher you just collect.

“I have trouble keeping it simple. I’m just a country girl gone wild, I guess.”

The Allens grew up in San Angelo.

“We lived across the street from each other,” Melody Allen said. “We were high school sweethearts, and we’re still sweethearts. this is our 41st year.”

The Allens left for school and work, but returned in 1976. Melody Allen retired from teaching piano in 2003, after the death of her father, Josh Johnson. the Allens took on running the drug-testing business he founded, Southwest Consortium, and started looking around for other investments. They bought the Elm Street property, which had been turned into an apartment complex.

“We bought it as a rental property in the beginning,” Melody Allen said. “But then we decided it has the character to be a bed and breakfast.”

A wide door with a big window and swag trim is a highlight of the front porch, which is furnished with welcoming rockers, potted plants and birdhouses.

“It’s the original door, over 100 years old. They just don’t make doors like that anymore,” Allen said.

They advertise the business — primarily on the Internet — as a “bed-bath-breakfast” because each bedroom has a private bath, something that is not common in bed-and-breakfast inns. each suite also includes a “tea room” and parlor. the tubs in two suites are jetted, and an outdoor hot tub is also available for guests.

“Sometimes I’ll just sit and look around. My husband says you just love to be in this environment. And I do,” Allen said.

The Allens are refurbishing the property’s carriage house, where they plan to live. They share the gardens with two kittens, Bach and Beethoven, and recently bought a camouflage-painted John Deere four-wheel Gator.

“My husband thinks he’s going to drive it, but I think I’m going to put some tassels on it and tool around in it. the surrey with the fringe on top comes to mind,” Allen said.

How did you come up with the name?

I played with it for a long time. Wanted something that fit us all the way around. all the rooms were named with a music and garden theme (Melody Morning Glory Master Bedroom, Andante Agave Bedroom, Allegretto Jalapeño Suite and La-La-Lavender Suite). we put a piano out on the curb to push the musical theme outside.

What is your breakfast menu?

The garden part of this is that we grow zucchini, okra, asparagus, Swiss chard, herbs such as mint, spearmint. we write the day’s menu on this tile. Breakfast is at 9 a.m. the house dish is Mozart Bacon Chard Quiche. we also typically offer Rachmaninoff Romanov, a dish of berries in a sweetened sour cream, berry-flavored custard, Bach Berry Oat Scones, sausage balls. everything is made from scratch. If you have a guest who stays two or three days, you can’t serve the same thing.

Do you have help with the work of running an inn?

I have a housekeeper and someone to help with the cooking and someone to help with the gardening.

How are you getting the word out?

The Internet, you have to do the Internet. also the chamber of commerce and the convention and visitors bureau. Bedandbreakfast.com, Google. Advertising locally isn’t really the market. Building friendships is really what we’re doing. I think bed and breakfasts get a different kind of clientele than regular places.

How many guests have you had?

We’ve had someone every other weekend on average. during the rodeo, Valentine’s Day, the big freeze, we were booked solid. we have people who have booked all the way through August. We’ve had couples that have met up here. a couple coming from Austin and a couple coming from Andrews met here, spent a weekend. Parents of Goodfellow kiddos that were here. a couple from England who live in Dallas. He instructed me how to serve tea properly.
